2. Personal Information We Collect

We may collect the following types of personal information:

  • Identity and contact details — name and email address when you submit our contact form
  • Communication content — the message you send us
  • Technical information — IP address, browser type, device type, and general location derived from IP
  • Usage information — pages viewed and interactions with the Website (where analytics cookies are enabled with your consent)
  • Cookie and consent records — as described in our Cookie Policy

We do not intentionally collect sensitive information (such as health records) through the contact form. Please do not include medical details unless necessary; if you do, you consent to us handling that information solely to respond to your enquiry.

3. How We Use Personal Information

We use personal information for purposes that include:

  • Responding to enquiries and providing customer support
  • Operating, securing, and improving the Website
  • Measuring Website performance (only with your consent for non-essential analytics or marketing cookies)
  • Meeting legal and regulatory obligations in New Zealand
  • Protecting our rights and preventing misuse of the Website

We will not use your information for direct marketing by email or text unless you have given clear consent or an exception under the Unsolicited Electronic Messages Act 2007 applies. You may opt out of marketing at any time.

4. Legal Basis for Collection and Use

Under the Privacy Act 2020, we collect personal information only where it is necessary for a lawful purpose connected with our functions. We rely on:

  • Your consent — for example, when you tick the consent box on our contact form or accept non-essential cookies
  • Contract or pre-contractual steps — if you purchase optional coaching or digital products
  • Legitimate purposes — such as site security, fraud prevention, and internal reporting, where this does not override your privacy interests
  • Legal obligations — where we must retain or disclose information by law

5. Disclosure to Third Parties

We do not sell personal information. We may disclose information to:

  • Hosting, IT, and email service providers who process data on our instructions
  • Analytics or advertising partners (only if you consent to the relevant cookies)
  • Professional advisers (lawyers, accountants) where reasonably required
  • Regulators, courts, or law enforcement when required by New Zealand law

Where a provider is located outside New Zealand, we take reasonable steps to ensure they protect your information in line with IPP 12 (disclosure outside New Zealand), such as contractual safeguards or use of providers in jurisdictions with comparable privacy standards.

6. Retention

We keep personal information only as long as needed for the purposes above:

  • Contact form records: up to 12 months after our last communication with you
  • Cookie consent logs: up to 12 months
  • Analytics data: up to 26 months in aggregated or de-identified form where applicable
  • Transaction records (if any paid services): as required for tax and accounting laws (typically 7 years)

When retention ends, we delete or de-identify information where practicable.

7. Security and Notifiable Privacy Breaches

We use reasonable safeguards, including HTTPS encryption, access controls, and secure hosting. No method of transmission over the internet is completely secure.

If a privacy breach is likely to cause anyone serious harm, we will notify affected individuals and the Office of the Privacy Commissioner as required under the Privacy Act 2020.

8. Your Rights Under the Privacy Act 2020

You may request:

  • Access to personal information we hold about you
  • Correction of inaccurate, incomplete, or misleading information
  • Withdrawal of consent (where processing is consent-based), without affecting prior lawful use

We will respond within a reasonable time and no later than 20 working days unless an extension applies under the Act. We may need to verify your identity before releasing information.

To make a request, email customer@musclesdyn.world with your name, contact details, and the nature of your request.

9. Visitors from Overseas

If you access the Website from outside New Zealand, you understand that information may be processed in New Zealand. Where EU/UK data protection law applies to you, you may also have rights under the GDPR; contact us and we will assess your request in good faith alongside our New Zealand obligations.

10. Children

The Website is intended for adults. We do not knowingly collect personal information from children under 16 without parental consent. If you believe we have collected a child’s information, contact us and we will delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated date. Continued use of the Website after changes are posted means you accept the updated policy, to the extent permitted by law.

12. Complaints
